Terms of Service

Goods and Services (“Product”,”Costume”) are provided to you (“Buyer”, “Customer”) by Scarrel (“Maker”).
By purchasing from this Maker you agree to abide by their Terms of Service. If at any time the Buyer no longer wishes to abide by the ToS, they may seek a Buyer-initiated termination. Any active commissions will be forfeited and payments will not be refunded. See Termination for further information.
This contract is legally binding and requires the knowledgeable consent of a person 18 years of age or older. IF YOU ARE UNDER 18 YOU CANNOT LEGALLY AGREE TO THIS CONTRACT. Any persons found to have falsified their age will be banned from commissioning and buying from this Maker until further notice.
You hereby agree not to harass, lie, slander, falsely incriminate, or otherwise behave with malice, intended or otherwise, towards Scarrel and associated parties, including but not limited to other Buyers.

Liability & Copyright

All Products and Services are provided “as-is” and the Maker cannot be held liable for damages or harm incurred from Products or Services. Requested changes to the design of a partially completed Product may be rejected, or may increase the total cost. Commissions do not have a promised timeline or due-by date and the Maker will not be held responsible for any time-related customer grievances.
The Maker is not under any circumstances required to refund the Buyer for an unsatisfactory Product.
The Maker reserves the right to take and use photos of any Product they have made, including publishing images to websites and using photos for publicity or advertisements. The Buyer may publish images only when rightful credit is given to Scarrel and never for commercial purposes. In the event of a terminated commission, original character rights not owned by the Maker will not be resold.

Privacy

All personal information, such as legal name, address, phone number, and body measurements will never be shared with third parties, except in the case that it is required by law or necessary for legal action. Proof of age may be requested for confirmation or security purposes. Any license, birth certificate, etc., will never be shared unless required by law or necessary for legal action.

Contact

If at any time the Maker loses contact with the Buyer, they will attempt contact on all available platforms. If the Buyer has failed to resume contact after 30 days, the commission will be presumed cancelled. See Termination for more information.
If the Buyer loses contact with the Maker, they are instructed to attempt contact on all platforms and wait at least 30 days for a response. If the Maker has failed to resume contact after 30 days, the Buyer may presume the commission terminated. See termination for more information.

Payment & Shipping

All payment must be made through PayPal’s Goods and Services direct email invoice. Any other payment methods, including PayPal Friends and Family, are invalid and will not count towards any down payments, payment plans, full payments, or add-ons.
Down payments must be made within 7 days of the Maker sending an email invoice to the Buyer. The first monthly payment in a payment plan must be made no more than 30 days after the down payment, and there may be no more than 30 days between each monthly payment in a payment plan. Failure to comply may result in the termination of a Buyer’s commission.
Two 30-day periods of missed Buyer payments will result in default termination of the commission. Products will not be shipped until the Buyer has paid in full. Shipping costs must be covered by the Buyer and may be requested separately from the base purchase price. The Maker will not be held liable for any damages or loss of Product encountered in third-party shipping.
The Maker will not be required to issue refunds under any circumstance.

Warranty

If the Product fails to meet the durability or quality standards of the Maker within the first 12 months, it may be returned to the Maker and repaired free of charge. The Buyer will be financially responsible for shipping both ways. Minor repairs may be carried out by the Buyer only with expressed permission. Unpermitted repairs will immediately void the 12-month warranty. Costumes with unpermitted repairs may still be eligible for repairs from the Maker with a repair fee.
Repairs requested after the warranty has expired will be subject to a repair fee. The Buyer is financially responsible for shipping. Repair requests may be rejected if the warranty has been voided or the costume has been badly damaged.
The warranty does not include damage caused by abuse, such as burns, ripped seams, melted glue, washed/scrubbed eyes, etc. Severe damage must be assessed by the Maker and will be subject to a repair fee if deemed salvageable. Costumes which are unwashed or have a foul odor are not eligible for repairs.
CONTACT WITH PRIVATE BODY PARTS OR TOXIC CHEMICALS WILL IMMEDIATELY VOID THE 12-MONTH WARRANTY AND THE COSTUME WILL NOT BE ELIGIBLE FOR REPAIRS OF ANY KIND BY THE MAKER.

Termination

Buyer-initiated termination, default termination, and Maker-initiated termination will all be handled in the same manner. By terminating your commission, or having your commission terminated, you forfeit all rights to receive the Product and any payments you have sent to the Maker.
IF YOU ARE FOUND TO HAVE BROKEN ANY TERMS OF SERVICE RULES YOU WILL IMMEDIATELY FORFEIT ANY PRODUCT OR REFUND PREVIOUSLY PROMISED TO YOU AND THE MAKER WILL NOT BE OBLIGATED TO COMPENSATE YOU IN ANY WAY.
Once a commission has been terminated, partially or wholly completed Products may be modified and/or resold by the Maker without notice or compensation to the previous Buyer of the Product. Original character rights not owned by the Maker will not be sold.
Scarrel reserves all rights to terminate or refuse commissions from anyone for any reason, stated or otherwise.

Reselling

For reselling due to a cancelled commission, see Termination.
If at any time the Buyer wishes to resell their costume, the Maker must be notified of the costume’s new owner within 30 days or as soon as possible, whichever comes first. The new owner of the costume is not automatically bound to these ToS and is not eligible for warranty coverage. Repairs will be handled only if the new owner agrees to the ToS and without any guarantees.
These terms and conditions are subject to change and may be modified at any time, and without warning. It is the Buyer’s sole responsibility to stay informed of these changes.
